AMBORELLA PARTIES LLC TERMS & CONDITIONS

RESERVATIONS/BOOKINGS – Amborella Parties LLC Rental Goods will be booked and reserved only upon online checkout and payment of the rental amount and security deposit.

CANCELLATIONS - Cancellations made 7 days in advance will receive a full refund. Cancellations made thereafter will receive a 50% refund. Cancellations made within 24 hrs will receive refund of the security deposit only.

DELIVERY – Due to the nature of Amborella Parties LLC rental goods, delivery, setup and pick up is a requirement. Orders are typically delivered 1-2 hours in advance of your event.

RECEIPT - The client (or assigned representative, please email us with name and telephone number at [email protected]) should be available to receive and count all rental goods upon delivery and pickup. Otherwise our counts will be considered accurate.

SETUP – For the rental of Amborella Parties LLC goods, setup at location is a requirement.

ACCESS – Delivery and Pickup is expected to be at street level or accessible by elevator. Access by stairs is not considered possible and will void the rental. Our Candy Carts are 31.5” wide (decoration wheels can be removed down to 30”). Rental location front door and room access is preferable 34” wide (a typical home front door is 35/36” wide) and can also be achieved through a rear door or internal door with an opening width of at least 32” (a typical door inside is 32” wide, assuming the door can swing open 180 degrees).

WEATHER - Amborella Candy Carts are hand painted and will damage from rain. They shall not be placed outdoor without a closed roof over it. Please plan for and be sure all equipment is secured and protected from the weather.

CLEANUP - All food or other items placed on our rental carts by our client(s) should be removed before pickup.

PICK UP – For the rental of Amborella Parties LLC goods, pick up at location is a requirement. Pickups occur 1-2 hours following your event. Responsibility for equipment remains with the client from the time of delivery to the time of pickup.

SECURITY DEPOSIT – The security deposit is to cover any costs of repairs or additional work required outside these terms & conditions (e.g. clean up). Upon pickup of the rental equipment any damage or otherwise will be established by photo(s). Amborella Parties LLC reserves the right to withhold return of the security deposit and settle cost(s) of repairs.

PERSONAL INJURY & PROPERTY DAMAGE – Amborella Paties LLC rental goods are static Candy Carts, décor Backdrops and Accessories which have a low risk of being the cause of personal injury or property damage. Notwithstanding, client agrees that if legal proceedings are brought against Amborella Parties LLC for compensation for personal injuries or property damage arising out of an event, client will indemnify Amborella Parties LLC and its employees against any judgments which may be rendered against them except for judgments on claims which arise out of negligence, gross negligence or willful acts or omissions of Amborella Parties LLC, its agents, servants or employees.

FAILURE TO DELIVER – Due to unforeseen reasons Amborella Parties LLC may not be able to deliver the rental goods at location and time agreed. In such a case Amborella Parties LLC cannot be held liable and will refund the rental amount and security deposit within 5 business days. Unforeseen reasons include but are not limited to inclement weather (e.g. heavy rain, floodings, snow/ice storms, high winds, tornadoes or warnings in the area, hurricanes) or other unexpected events (e.g. significant damage during a prior rental event, in which case we will contact you ASAP with any available alternatives, and/or car and or cargo trailer damage or breakdown, illness by the delivery team).

INDEMNIFICATION - To the fullest extent permitted by law, customer indemnifies, releases and holds Amborella Parties LLC harmless against any and all claim, expense, cause of action, damage, liability, cost, penalty, tax, assessment, charge, punitive damage or expense by reason of any act or omission of customer or its employees, agents, contractors, subcontractors, affiliates or invitees.

DEFENSE - The client is solely responsible for any additional charges incurred as a result of failure to meet these conditions. All collection fees, attorney’s fees, court costs, or any expense involved in the collection of rental charges will be client’s responsibility.
